ApplyGenius Terms of Service

Effective October 5, 2026 · Version 2026-10-05

1. Agreement and eligibility

These terms are an agreement between you and Apply Genius LLC, with a mailing address at 9169 W State St #3861, Garden City, ID 83714, United States ("ApplyGenius," "we," "us," or "our"). They govern our website, application and related services made available under these terms. You accept through the acceptance mechanism presented to you or an applicable order. You must be at least 18 and able to enter a binding agreement. If acting for another person or organization, you must have authority. Contact: admin@applygenius.co.

The Privacy Policy explains personal-information practices. An accepted order or feature-specific agreement controls its expressly stated subject matter if it conflicts with these terms. Source-specific privacy restrictions and mandatory rights always prevail. A partner's separate purchase agreement is not rewritten by these terms.

2. Services, beta access and changes

ApplyGenius provides career, networking, productivity and application-related tools and assistance. Features may use AI, automated agents, human support and third-party services. Availability depends on your plan, access, integrations and supported workflows. Related new features may be offered under these terms with supplemental notices or agreements; mentioning them does not promise delivery.

The product is in closed beta. We may test, modify, limit, suspend or discontinue features, providers or beta access, impose reasonable capacity limits and replace integrations. Changes remain subject to expressly purchased commitments, required notice and nonwaivable remedies. Roadmaps, pilots and expected release dates are not contractual commitments unless expressly included in a signed order.

3. Accounts and accurate information

Provide accurate, current information, protect account access and promptly report suspected unauthorized activity. You are responsible for actions you authorize and reasonable precautions with credentials, but not liability the law places on us. You must have permission to provide third-party information; do not disclose confidential employer material or others' credentials without authority.

Review material facts in profiles, resumes, answers and communications. Do not instruct us to fabricate qualifications, relationships, experience or eligibility. We may rely on your information and instructions without independently verifying every statement.

4. Content rights, feedback and data products

You retain rights in your content. To the extent you have those rights, you grant ApplyGenius a nonexclusive, worldwide, royalty-free license to host, store, copy, format, adapt, analyze, display and transmit it to operate, secure, support and improve the services you use and carry out your instructions. We may sublicense these rights to providers and transfer them in an authorized business transaction, only within the same purposes and privacy restrictions. The license lasts as needed for those purposes and permitted retention; it is not an irrevocable right to retain personal information forever.

We may develop and commercialize eligible aggregate insights and properly deidentified information as described in the Privacy Policy. Selling or licensing identifiable information for independent commercial purposes, including external AI-model training, requires the separate disclosures and permissions described there. The service-content license does not enroll you in that program or override source restrictions.

If you voluntarily provide product suggestions or feedback, you grant us a perpetual, worldwide, transferable, sublicensable, royalty-free right to use those ideas without compensation or attribution. This concerns ideas about our service, not a right to disclose personal information, publish your name or testimonial, or use third-party confidential content. We may independently develop similar ideas.

We and our licensors retain rights in our software, interfaces, designs, methods, trademarks and service materials. Subject to compliance, you receive a limited, nonexclusive, nontransferable right to use the service for its intended purpose. AI outputs may not be unique or protectable; we do not promise exclusive rights against others.

5. Authorized automation and third parties

Enabling an available workflow authorizes the actions described in its settings and notices, within your permissions. These may include preparing or sending messages, making connection requests, creating or accessing application accounts, using a designated inbox for verification, submitting applications and recording results. Execution providers may perform those actions. A workflow requiring individual approval cannot be released merely by your acceptance of these terms.

If you expressly enable a review-window workflow, its stated deadline may authorize release of the prepared package if you do not stop or change it in time, as explained when enabling that feature. That choice is distinct from consent to new data purposes, account permissions or unrelated legal commitments. These terms alone do not activate automation or authorize payment, false attestations or unrestricted account access.

Stop requests and disconnections apply prospectively as technically practicable; completed actions may not be recallable. Queued, attempted, submitted and confirmed are different states. Not every site, challenge or deadline can be supported. A failed or uncertain workflow may require manual completion. Keep your own copies of important records.

Third parties control their availability, rules, limits and decisions; they may change services, reject activity or restrict accounts. You must comply with their terms and applicable law; this agreement does not override them. Integration does not imply endorsement. Except for duties we expressly assume or law imposes, we are not responsible for third parties' independent acts.

6. Fees, renewal and refunds

Charges, billing intervals, usage limits and cancellation methods are those disclosed in the accepted order or checkout. You authorize only agreed charges and applicable taxes. Recurring plans renew only where renewal and cancellation terms were disclosed and accepted as required. Price changes apply prospectively with required notice; these terms create no undisclosed subscription or charge.

Except where an order or law provides otherwise, fees for delivered services, elapsed subscription periods or consumed usage are nonrefundable. Cancellation stops future renewals under the accepted plan; it does not itself create a prorated refund for completed service. Required refunds, cooling-off rights and remedies remain available. A partner's agreement governs its charges. Contact us about billing concerns; nothing waives a lawful payment dispute or chargeback right.

7. Acceptable use and enforcement

Do not act unlawfully, infringe rights, send prohibited spam, harass, deceptively impersonate, access data without authority, bypass security or usage limits, interfere with service, or resell access without written permission. Reverse engineering is prohibited except where mandatory law allows it. We may investigate misuse, remove content or restrict access as reasonably necessary for security, compliance, nonpayment or material breach.

8. No outcome or AI guarantees

We do not guarantee placement, employment, interviews, introductions, employer responses, compensation, third-party acceptance or return on spending. Networking research describes that research, not measured ApplyGenius results or a promise to you. AI content may be incorrect, incomplete or unsuitable. The service is not legal, tax, immigration or regulated professional advice.

To the maximum extent permitted by law, the service and outputs are provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose or noninfringement. We do not warrant uninterrupted, error-free or completely secure operation. Signed-order commitments and legally required warranties are not excluded.

9. Limits of liability

To the maximum extent permitted by law, ApplyGenius and its service suppliers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or loss of anticipated employment, profits, revenue, goodwill or business opportunity arising out of the service, even if advised of that possibility.

To that same extent, their combined aggregate liability for claims arising out of or relating to these terms or the service will not exceed the greater of US $100 or the amount paid to ApplyGenius by you or on your behalf for the affected service during the 12 months before the first event giving rise to liability. Related claims do not multiply the cap. These limits apply across contract, tort and other legal theories.

Nothing excludes liability for fraud, willful misconduct, gross negligence where it cannot be limited, death or personal injury where exclusion is prohibited, or privacy, consumer or other liability or remedies that cannot lawfully be excluded or capped. A prohibited limitation applies only to the lawful extent. Your payment obligations are not reduced by our liability cap.

10. Third-party claims

To the extent permitted by law, you will indemnify ApplyGenius for reasonable losses, costs and legal fees arising from a third-party claim caused by content supplied without necessary rights, your unlawful instructions, intentional misuse or material breach. This does not cover a claim to the extent caused by our breach, negligence or unlawful conduct. We will give prompt notice, reasonably cooperate and allow an appropriate defense; no settlement may impose an admission or nonmonetary obligation on you without consent. Nonwaivable consumer rights remain intact.

11. Ending service

You may stop using the service and request closure through support. We may terminate for material breach, misuse, legal necessity or discontinuation, subject to required notice, paid commitments and legal remedies. Termination ends your access license but does not recall external actions. Retained data remains subject to the Privacy Policy. Accrued payments and provisions that by nature survive, including IP rights, permitted content rights, liability limits and disputes, continue only within their stated scope.

12. Disputes and general provisions

These terms are governed by Illinois law, excluding conflicts-of-law rules, except where mandatory law requires otherwise. Subject to nonwaivable local venue rights, courts in Cook County, Illinois, and the United States District Court for the Northern District of Illinois have exclusive jurisdiction. Please contact admin@applygenius.co first to try resolving a concern; this is not a barrier to urgent relief, regulator complaints or protected claims.

These terms do not impose binding arbitration or waive class-action rights. If a provision is unenforceable, the rest continues as lawful. Delay in enforcement is not a waiver. We may assign this agreement in a merger, reorganization or sale of the relevant business, subject to privacy commitments and required consent. You may not assign without written consent except where law permits. Neither party is responsible for delay from events reasonably beyond its control, except accrued payment duties and obligations the law does not excuse.

Updates apply prospectively with appropriate notice and renewed agreement where required. No update silently rewrites a prior order, resolves an existing dispute in our favor or authorizes new personal-data uses. Electronic notices and records may be used as law permits. These terms and accepted supplemental agreements form the agreement for their subject matter, without excluding misrepresentation liability or nonwaivable rights.
